The crash occurred around 4:00 p.m. on January 6, 2024, at the intersection of US Highway 40 and State Road 39 in Clayton, Indiana. According to Hendricks County Sheriff's deputies, a westbound vehicle operated by Tiffany Poole failed to yield the right of way, colliding with an eastbound vehicle carrying two occupants. Following the incident, Poole was taken to a local hospital for a mandatory blood draw before being transported to Hendricks County Jail on preliminary charges of driving under the influence, pending toxicology results.

Location and Infrastructure

The intersection of US-40 and State Road 39 serves as a crucial junction in Hendricks County, connecting Clayton to neighboring communities. US-40, also known as the Historic National Road, is a major east-west thoroughfare that carries significant local and commercial traffic through the region. The intersection is controlled by traffic signals and features dedicated turn lanes, but historically has presented challenges due to high-speed approaches and varying traffic patterns throughout the day. The area is surrounded by both residential and commercial development, with the Clayton Community Park located nearby, making it a frequent crossing point for both local and through traffic.

Legal Rights and Considerations

Under Indiana Code § 9-30-5, driving while intoxicated that results in death can be prosecuted as a Level 4 felony, carrying significant criminal penalties. Victims and their families may be entitled to both compensatory and punitive damages through civil action, with Indiana's modified comparative fault system allowing recovery as long as the plaintiff is less than 51% at fault. The statute of limitations for personal injury claims in Indiana is two years from the date of the accident. Potential compensation may include medical expenses, funeral costs, loss of income, and non-economic damages such as pain and suffering. Insurance claims typically involve both liability coverage and potential uninsured/underinsured motorist coverage.
