Legal Rights and Considerations

Under Nevada law, victims of hit-and-run accidents and their families have specific legal protections. Nevada Revised Statutes (NRS) 484E.010 makes leaving the scene of an accident resulting in injury or death a felony, punishable by up to 20 years in prison. For victims and their families, Nevada's wrongful death statute (NRS 41.085) allows certain close relatives to pursue compensation for losses including medical expenses, funeral costs, lost financial support, and pain and suffering. The statute of limitations for wrongful death claims in Nevada is generally two years from the date of death, making timely legal consultation crucial. Victims may seek compensation through multiple insurance avenues, including the at-fault driver's liability coverage, uninsured/underinsured motorist protection, and potentially the pedestrian's own auto insurance policy, even though they weren't in a vehicle at the time of the accident.
